Synopsis:

With the transfer of the management of Rupbasan (State Storage Houses for Seized Assets) to the Asset Recovery Agency (BPA), this transition momentum should also be accompanied by improvements in the governance of seized and confiscated assets. This study aims to provide a critical assessment of the issue. It evaluates the management of seized and confiscated assets by referring to the key principles in the management of criminally derived assets, namely: (1) the existence of a management system that promotes integrity, accountability, and transparency; (2) guarantees for the protection of good-faith third parties; and (3) cost management and efficiency enhancement.

Observations regarding governance issues in Rupbasan, based on the three principles above, indicate that the management of Rupbasan has long faced various challenges, including: (1) a regulatory framework that is not aligned with practical needs in fulfilling the principles of third-party protection as well as cost management and efficiency; (2) a lack of transparency due to unclear divisions of authority among institutions; (3) difficulties in maintaining the valuation of assets; and (4) limitations in infrastructure and human resources in managing Rupbasan.
