Synopsis:

This pocket book was compiled based on a literature study on dispensation of marriage as one of the doors in child marriage which still causes polemic in society. Marriage dispensation before PERMA No. 5 of 2019 does not yet have a uniform examination process based on the best interests of the child. The purpose of writing this pocket book is:

1. Become a reference for judges and court staff on key issues related to child marriage in Indonesia.
2. Increase judges’ understanding of the condition of child marriage in Indonesia and the reality on the ground regarding the practice and adverse effects of child marriage.
3. Serve as a reference for judges regarding the legal basis in handling cases of marriage dispensation to ensure steps to prevent the adverse effects of child marriage.
4. Provide recommendations and information on important matters that need to be considered in handling cases, to ensure the fulfilment of the best interests of the child, especially in legal considerations of requests.
