Synopsis:

In current practice, women have greater difficulties when undergoing the criminal justice process because they are often discriminated against due to the negative stigma against women in society. The Supreme Court and the Attorney General’s Office issued several policies that aim to serve as guidelines for law enforcers in protecting the rights and preventing discrimination against women in the criminal justice environment, namely Supreme Court Regulation Number 3 of 2017 concerning Guidelines for Adjudicating Cases of Women Against the Law and Attorney General Guidelines Number 1 of 2021 concerning Access to Justice for Women and Children in Handling Criminal Cases.

In addition, the Supreme Court also issued another inclusive policy to protect and prevent children from child marriage, namely Supreme Court Regulation Number 5 of 2019 concerning Guidelines for Adjudicating Marriage Dispensation Applications. This book evaluates the implementation of these three policies by looking at the implementation in 6 regions in Indonesia. This evaluation of implementation is intended to contribute to the improvement of an inclusive criminal justice system for women in Indonesia.
