Wetboek van Strafvordering (Sv) is the Criminal Procedural Code (CPC) which applies in the Dutch Legal System. The Dutch CPC was first passed in 1921, and has continued being in effect since 1926 until now. Near its 100 (one hundred) years application, the Dutch Criminal Procedure Code has undergone up to 400 (four hundred) amendments. This means the Dutch government revised its CPC an average of 4 (four) times each year. This demonstrates the Dutch government’s responsiveness in revising its laws to ensure they remain relevant to current developments.
Some of the recent developments in the Dutch CPC are as follows (Kempen, Krabbe, Brinkhoff, The Criminal Justice System of the Netherlands, 2019: 97-106): 1) the police investigation crisis and reform based on the report of the Van Traa committee on special investigative powers (1999); 2) internalization of principles in the European Convention on Human Rights and Fundamental Freedoms (ECHR) into the Dutch Criminal Procedure Code (2017); 3) internalization of European Union Law (2017) into the Dutch Criminal Procedure Code; 4) technological progress, such as DNA testing and interception authority for computer crimes (2018); 5) strengthening the legal position of victims (2011); and 6) modernization of criminal justice through efforts to digitalize judicial procedures (2016).
Historically, Indonesian criminal procedure law has always been deeply rooted in and inextricably linked to Dutch criminal procedure law. This means that the Dutch CPC is still relevant as an important reference to study, implement, and reform the Indonesian CPC.
