Synopsis:

The Supreme Court and the Attorney General’s Office have implemented various policies to handle cases involving women and children as vulnerable groups in conflict with the law. Monitoring and evaluation is important to ensure that these policies are effective and able to respond to the needs of their target groups. As a series of processes that assess performance and impact, monitoring and evaluation can identify whether a regulation has been implemented well, faces obstacles in implementation, or requires updating because it is no longer relevant.

This study focuses on the implementation of policies for handling criminal cases, especially sexual violence, as well as civil cases related to divorce and marriage dispensation. Specifically, monitoring and evaluation is carried out on the implementation of Supreme Court Regulation No. 3/2017 on Guidelines for Adjudicating Cases of Women Against the Law (hereinafter Perma 3/2017), Supreme Court Regulation No. 5/2019 on Guidelines for Adjudicating Marriage Dispensation Cases (hereinafter Perma 5/2019), and Attorney General Guideline No. 1/2021 on Access to Justice for Women and Children in Criminal Cases (hereinafter Guideline 1/2021). Perma 3/2017 and Perma 5/2019 have been implemented for more than 5 years as guidelines for Judges in handling cases related to women and children, during this time there has also been a lot of socialization carried out by the Supreme Court regarding these internal regulations.
