Various laws and regulations now incorporate restorative justice, including conditional sentencing (voorwaardelijke veroordeling), as stipulated under Articles 14a–f of the Indonesian Penal Code (KUHP). There are 2 (two) types of conditional sentencing in these provisions: general conditions (KUHP, Article 14a) and special conditions (KUHP, Article 14c). However, there is no comprehensive technical explanation or derivative regulations of Articles 14a–f of the KUHP.
This book, initiated by the RJ Consortium—comprising ICJR, IJRS, and LeIP in collaboration with Bappenas—serves as a guide for law enforcement officers, particularly prosecutors and judges, to understand the key considerations before, during, and after implementing conditional sentencing. It also elaborates on the relationship between conditional sentencing and restorative justice, the parameters of offences eligible for conditional sentencing, the imposition of conditional sentences with general, special, or combined conditions, as well as a technical explanation of the application of Articles 14a–c of the KUHP.
